1. About This Website

1.1 Welcome to www.theunapologeticceo.au (Website). The Website is operated by Cherie Rudzitis trading as The Unapologetic CEO (ABN 98 720 213 790) (we, us, our).

1.2 The Website provides access to a free resource (the "10 Signs Your Business Still Depends On You" checklist) and the opportunity to book and pay for a one-on-one coaching consultation, currently offered as the Business Dependency Audit (Audit).

1.3 Access to and use of the Website, the checklist, and the Audit is subject to these terms and conditions (Terms). By using, browsing and/or reading the Website, you confirm you have read, understood, and agree to be bound by the Terms. If you do not agree, you must stop using the Website immediately.

1.4 We reserve the right to review and change any of the Terms by updating this page at our sole discretion. Changes take effect immediately from the date of publication.

2. Acceptance of the Terms

You accept the Terms by using, browsing, or accessing the Website. Continued use of the Website after any changes to the Terms constitutes your acceptance of those changes.

3. Providing Your Information

3.1 To receive the free checklist or to book the Audit, you will be asked to provide personal information such as your name and email address (and, for the Audit, payment details).

3.2 You warrant that any information you provide is accurate, correct and up to date.

3.3 Your personal information is handled in accordance with our Privacy Policy.

4. Your Obligations

When using the Website, you agree that you will:

We may remove any unauthorised commercial solicitation from the Website without notice and take appropriate legal action for illegal or unauthorised use.

5. The Free Checklist

5.1 The "10 Signs Your Business Still Depends On You" checklist is provided free of charge in exchange for your name and email address.

5.2 The checklist is general information only and does not constitute personalised business, legal, financial, or professional advice.

6. The Business Dependency Audit

6.1 The Business Dependency Audit is a paid, one-on-one 45-minute consultation, currently priced at A$67 (Purchase Price), booked through our third-party scheduling provider (currently Calendly), with payment processed securely through Stripe. We do not see or store your card details.

6.2 Payment of the Purchase Price is required at the time of booking. We are not currently registered for GST, so GST does not apply to the Purchase Price.

6.3 By booking the Audit, you confirm you have read and agree to be bound by the applicable terms and privacy policy of our booking and payment provider.

6.4 Once payment is confirmed, you will receive a booking confirmation. We may retain your booking and payment details for our records.

6.5 If a payment is declined, reversed, or otherwise unpaid, you are responsible for any resulting costs or fees.

7. Rescheduling and Refunds

7.1 If you need to reschedule your Audit, please contact us at hello@theunapologeticceo.au with as much notice as possible, and in any event at least 24 hours before your scheduled time.

7.2 Subject to your rights under the Australian Consumer Law, the Audit is non-refundable once the session has taken place.

7.3 Refunds are not processed automatically by Calendly or Stripe. If a refund is agreed, we will process it manually through Stripe, and it may take several business days to appear back in your account.

8. Warranty

8.1 We will use our best efforts and reasonable skill to deliver the Audit and provide genuinely useful guidance. We make no warranty or guarantee that the Audit, the checklist, or any advice given will produce any particular result for your business.

8.2 Nothing in these Terms excludes, restricts or modifies any guarantee, warranty, right or remedy under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.

9. Disclaimer

9.1 You are solely responsible for the business, financial, and personal decisions you make, including any decisions made as a result of the checklist, the Audit, or any content we publish (including on our Website, social media, or podcasts).

9.2 Nothing provided through the Website, the checklist, the Audit, or our other content is a substitute for independent legal, financial, tax, or psychological advice. We recommend you seek independent professional advice before relying on any information or guidance we provide.

10. Information Disclaimer

Any information, advice, or content provided through the Website, our social media channels, or any related platform is general in nature and provided for informational purposes only. We take reasonable care in preparing this content but make no representation or warranty about its accuracy, reliability, completeness or suitability for your particular circumstances. To the extent permitted by law, we are not liable for any loss or damage arising from your reliance on this content.

11. Copyright and Intellectual Property

11.1 All content on the Website, the checklist, and any materials provided as part of the Audit are protected by copyright under Australian law. Unless otherwise stated, all rights are owned or controlled by us.

11.2 We grant you a limited, non-exclusive, non-transferable licence to access the Website and use the checklist for your own personal or business use only. You may not reproduce, resell, distribute, or publicly share our content without our prior written permission.

11.3 We retain all rights, title and interest in our business name, branding, and all Website and checklist content.

12. Privacy

Any personal information you provide through the Website is handled in accordance with our Privacy Policy.

13. General Disclaimer and Limitation of Liability

13.1 Nothing in these Terms limits or excludes any guarantee, warranty or right that cannot lawfully be excluded under the Australian Consumer Law.

13.2 To the extent permitted by law, our total liability arising out of or in connection with the Website, the checklist, or the Audit is limited, at our election, to resupplying the relevant service or refunding the amount you paid for it.

13.3 To the extent permitted by law, we are not liable for any indirect, special or consequential loss, loss of profit, or loss of business opportunity arising from your use of the Website, checklist, or Audit.

13.4 The Website and its content are provided "as is" and "as available," without warranties of any kind except as required by law.

14. Third Party Services

The Website integrates with third-party services (including Stan Store, Calendly and Kit) for delivery of the checklist, booking, and payment. We do not control these third-party services and are not responsible for their content, performance, or reliability. Please review their own terms and privacy policies.

15. User-Generated Content

If you submit any content to us (such as testimonials, comments, or messages), you are solely responsible for it. By submitting content, you grant us a royalty-free, non-exclusive licence to use it (including your name, where relevant) for promotional and marketing purposes, unless you tell us otherwise. We will not sell your content to third parties for their own commercial use.

16. Mailing List

You may choose to join our mailing list when you download the checklist or otherwise sign up. By doing so, you agree to receive marketing emails and updates from us. You can unsubscribe at any time using the link in any email we send.

17. Indemnity

You agree to indemnify us, our contractors and agents against any claims, costs, or damages arising from your breach of these Terms, your misuse of the Website, or any content you submit to us.

18. Jurisdiction and Governing Law

These Terms are governed by the laws of Queensland, Australia, and any disputes will be resolved in the non-exclusive jurisdiction of the courts of Queensland, Australia.

19. Independent Legal Advice

You acknowledge that you have had the opportunity to read these Terms and to seek independent legal advice before agreeing to them.

20. Severance

If any part of these Terms is found to be void or unenforceable, that part will be removed and the remainder will continue in full force.
